What appears to happen in cases of borrowed design like this is that artists are often told to “be flattered”; and when permission is asked (and the influence is acknowledged), it can certainly be that.
Could this be a case of common source material inspiring a similar idea? Alas, I do not think so. If Dominick’s original drawing is placed over the painting, the images match too well to be merely prompted by common culture:

While this might not be a strict example of copy and paste-plagiarism, there appears to be a misconception among some creators that if you make a certain number of changes to an image, it won’t be considered infringement. This is not true. There is no “10% change rule” to avoid infringement. It also isn’t fair use if it’s not offered as criticism or commentary, and since the artist, Rob Chandler says he’s selling prints, fair use doesn’t apply here.
I’ve tried to privately contact @roboch before writing this, but he has not responded either to myself or the original arist. Perhaps a more public approach will oblige a response, and hopefully a dialogue with the original artist Dominick DiGregorio, aka @halfassedtenacity.
Thanks cyrillictypewriter for makinig me aware of this and for trying to reach roboch on my behalf. I have reached out as well to no avail. I’m deeply disappointed that roboch has decided not to address this issue.
